4th Circ. Knocks Ladder Co. Down A Few Rungs

Law360, New York (January 6, 2010, 3:42 PM EST) -- A federal appeals court has rejected a bid by Louisville Ladder Inc. to overturn a ruling in favor of a man who allegedly suffered multiple injuries after his brand-new ladder collapsed.

On Tuesday, the U.S. Court of Appeals for the Fourth Circuit affirmed the ruling in favor of plaintiff James Paul Pugh III, dismissing the ladder manufacturer’s argument that Pugh's experts should never have been allowed to testify.
