Fed. Circ. Reverses CIT On Duties For Jug Wraps

Law360, New York (January 6, 2010, 4:17 PM EST) -- Bottle and jug wraps imported in 2005 by Outer Circle Products are food organizers, not luggage, a federal appeals court has ruled, reversing a U.S. Court of International Trade ruling in a classification fight that initially went in favor of the government.

Tuesday's ruling, in the U.S. Court of Appeals for the Federal Circuit, means that a significantly lower duty rate on the imported items — 3.4 percent instead of 19.3 percent — was appropriate.
