Trade Secrets Suit V. Allparts Medical Tossed

Law360, New York (January 6, 2010, 2:39 PM EST) -- A federal judge has dismissed Remedpar Inc.'s trade secrets suit against rival aftermarket medical imaging equipment supplier Allparts Medical LLC, ruling that the company failed to state a claim under the Computer Fraud and Abuse Act.

Acknowledging that the U.S. Court of Appeals for the Sixth Circuit had yet to rule on similar issues under the CFAA, Judge Thomas Wiseman of the U.S. District Court for the Middle District of Tennessee on Monday adopted the Ninth Circuit's interpretation of the law and dismissed Remedpar's federal claims...
