8th Circ. Affirms Call For Arbitration In PRM Patent Suit

Law360, New York (January 11, 2010, 6:27 PM EST) -- A federal appeals court has upheld a lower court's decision allowing Japan's Kobe Steel Ltd. to force PRM Energy Systems Inc. to arbitrate a dispute arising from a patent licensing agreement for gasification technology, despite Kobe not being a party to the pact.

The U.S. Court of Appeals for the Eighth Circuit on Friday found that PRM's tort claims against Kobe were within the scope of an arbitration clause in a 1999 licensing agreement for PRM's gasification technology, striking down the PRM's appeal.
