Utilities Fired Up Over NM Cap On Greenhouse Gases

Law360, New York (January 14, 2010, 5:41 PM EST) -- New Mexico utilities have joined forces with lawmakers and energy industry groups to file a lawsuit challenging a state regulator's authority to implement a statewide cap on greenhouse gas emissions.

The plaintiffs filed suit Wednesday in the Fifth Judicial District of the State of New Mexico in Lea County, seeking declaratory judgment that the state’s Environmental Improvement Board lacks authority under New Mexico law to impose a cap on greenhouse gases and to change construction and permitting regulations to implement it.
