Neb. Town's Contract Suit V. Energy Co-Op Tossed

Law360, New York (January 15, 2010, 5:22 PM EST) -- Nebraska's high court has dismissed a breach of contract case brought by a Nebraska town against an energy cooperative, saying the town lacks standing to sue the group because it is a member of the organization.

The five-judge panel of the Nebraska Supreme Court issued its ruling Friday, rejecting the arguments of Falls City., Neb., which alleged the cooperative and its executives breached its contract with its members by investigating alternative methods of obtaining natural gas.
