Continental Wins On Proration In Indian Head Suit

Law360, New York (January 15, 2010, 7:31 PM EST) -- A judge has allowed Continental Casualty Co. to use a prorated, time-on-risk method in calculating its coverage obligations for vehicle brake component maker Indian Head Industries Inc.’s asbestos-related personal injury claims, potentially causing the company to have to reimburse certain defense costs.

Judge Denise Page Hood issued a ruling Wednesday in the U.S. District Court for the Eastern District of Michigan granting partial summary judgment to Continental in the coverage dispute brought by the insurer and affiliate Columbia Casualty Co.
