Cheerios Labeling Suit Sent Back To Local Court

Law360, New York (January 19, 2010, 12:59 PM EST) -- A consumer group has won an emergency bid to remand its lawsuit over health claims regarding General Mills Inc.'s Cheerios to the District of Columbia's local court.

Judge Henry H. Kennedy Jr. of the U.S. District Court for the District of Columbia on Friday granted the National Consumers League's motion to send the suit back to the Superior Court for the District of Columbia, finding that the federal court lacked subject matter jurisdiction and Article III standing.
