Ex-Koch Class Refiles Donning, Doffing Suit

Law360, New York (January 20, 2010, 1:14 PM EST) -- Nearly 80 Koch Foods Inc. employees whose Fair Labor Standards Act claims were dismissed when a judge decertified a class action against the chicken processor have refiled the suit as individuals, accusing the company of failing to pay the workers for time spent donning and doffing clothing.

The plaintiffs lodged their suit as individuals on Tuesday in the U.S. District Court for the Southern District of Mississippi, maintaining that their employer willfully violated the FLSA.
