Monsanto Sues Syngenta Over Patent For Gene Modified Corn

Law360 (May 13, 2004, 12:00 AM EDT) -- Agribusiness Monsanto Co. has filed a lawsuit against Swiss rival Syngenta AG for patent infringement, seeking to bar Syngenta from using technology used in producing a popular genetically modified corn.

The lawsuit, filed Wednesday in U.S. District Court in Delaware, centers on what Monsanto called its "fundamental technique" used in producing glyphosate-tolerant plants, namely corn.

“In pursuing commercialization of GA21(R) corn, Syngenta is in violation of Patent No. 4,940,835, which covers genes and vectors conferring glyphosate resistance in plants,” Monsanto said.
