Trumpf Fights To Nix Duties On Surgical Lamps

Law360, New York (January 25, 2010, 1:28 PM EST) -- Medical equipment maker Trumpf Medical Systems Inc. has asked the U.S. Court of International Trade to rule that U.S. Customs and Border Protection incorrectly classified and slapped duties on the company's imported surgical lamps.

Trumpf filed a motion for summary judgment Friday, seeking an order that the items should have been classified as instruments used in surgery and not as lamps.

Items classified as surgical instruments are duty-free, whereas those classified as lamps are subject to a 6 percent duty, according to Trumpf, the U.S subsidiary...
