Microsoft Uses Apple Defense In Datel Antitrust Suit

Law360, New York (January 25, 2010, 2:38 PM EST) -- In a bid to toss an antitrust lawsuit over restrictions on a competitor's Xbox 360 memory cards, Microsoft Corp. is invoking the precedent set by Apple Inc. in its successful dismissal of claims by unauthorized Mac products vendor Psystar Corp.

In a motion to dismiss filed Friday in the U.S. District Court for the Northern District of California, Microsoft argued that a December decision from the same court should be instructive to a judge's ruling on a suit brought by video games products maker Datel Design...
