US, Xerox Say Dispute Presents Issue Of 1st Impression

Law360, New York (January 25, 2010, 2:41 PM EST) -- A debate between the United States and Xerox Corp. over jurisdiction for a case challenging a U.S. Customs and Border Protection decision presents an issue of first impression for the U.S. Court of International Trade, the parties said.

Xerox and the U.S. filed a joint motion Friday asking the court to stay the case until it can rule on the government's Jan. 14 motion to dismiss, which argues that the trade court does not have jurisdiction to hear Xerox's challenge under U.S.C. § 1581(e).
