Biden Gets More Appeals Picks With 5th, 9th Circ. Openings

By Jack Karp (January 13, 2022, 4:11 PM EST) -- Two more appeals court judges announced their retirements this week, giving President Joe Biden even more opportunity to reshape the federal bench.

U.S. Circuit Judge Gregg J. Costa will be retiring on Aug. 5, the Fifth Circuit confirmed Thursday. Meanwhile, the Ninth Circuit announced Wednesday that U.S. Circuit Judge M. Margaret McKeown will assume senior status when a replacement is appointed.

The announcements mean that Biden now has 19 circuit court vacancies to fill, according to Law360's tracker.
