CIT Stays Xerox Toner Case For Jurisdiction Review

Law360, New York (January 27, 2010, 1:09 PM EST) -- The U.S. Court of International Trade has put a stay on Xerox Corp.’s suit contesting a U.S. Customs and Border Protection ruling over toner cartridges while the court addresses the federal government’s lack of jurisdiction argument.

Judge Gregory W. Carman on Monday agreed with Xerox and the government’s joint motion to place the case on hold until it resolves the government’s Jan. 14 bid seeking to dismiss Xerox’s action under U.S.C. § 1581(e) due to the CIT's lack of jurisdiction.
