Conoco Workers Lose 2nd Class Cert. Bid In FMLA Suit

Law360, New York (January 27, 2010, 3:14 PM EST) -- A group of employees claiming ConocoPhillips Co.'s attendance and leave policies violate the Family and Medical Leave Act has lost its class certification bid for the second time.

Judge S. James Otero rejected the plaintiffs' renewed request for class certification in the case in an order filed Tuesday in the U.S. District Court for the Central District of California, saying they had failed to meet their burden of proof that they were adequate class representatives.
