Calif. City Plastic Bag Ban Paused For Enviro Report

Law360, New York (January 29, 2010, 4:41 PM EST) -- A California appeals court has put a ban on plastic bags in the city of Manhattan Beach on hold until the city can conduct an environmental impact report on the effects of increased use of paper bags.

The Court of Appeal of the State of California for the Second Appellate District on Wednesday affirmed a ruling in favor of the Save the Plastic Bag Coalition, noting there is substantial evidence that banning stores from giving customers plastic bags could lead to increased use of paper ones....
