Canadian Lumber Co. Seeks Dismissal Of Import Suit

Law360, New York (February 1, 2010, 7:06 PM EST) -- A Canadian lumber company has moved for summary judgment in a case brought by the U.S. government, arguing that officials had no right to render imports from 2000 and 2001 subject to quotas under the U.S.-Canada Softwood Lumber Agreement.

Millenium Lumber Distribution Co. Ltd. on Friday asked the U.S. Court of International Trade to dismiss the case so the U.S. can't collect liquidated damages with respect to 168 entries of Millennium's imported merchandise made between April 25, 2000, and Jan. 3, 2001.
