Applikon Fights Customs Over Bioreactor Duties

Law360, New York (February 2, 2010, 12:33 PM EST) -- Applikon Biotechnology Inc. has sued U.S. Customs and Border Protection to recover duties the Dutch company says were incorrectly imposed on two shipments of bioreactor systems used for the production of cell cultures.

The consolidated complaint, lodged Monday in the U.S. Court of International Trade, claims Customs misclassified the imported bioreactors as systems for heating the liquid medium of the cell cultures rather than according to their mixing function, which principally enables cell growth.
