Court Demands Second Look At Union Neutrality Law

Law360 (December 7, 2006, 12:00 AM EST) -- In a blow to the Health Care Association of New York, the Second Circuit Court of Appeals has sided with Gov. George Pataki and New York Attorney General Eliot Spitzer in a battle over New York state’s union neutrality law.

On Thursday, the appellate court reversed and remanded a lower court decision, ruling that there is a serious dispute over facts that should nullify the earlier ruling and shoot it back down to the district court for further consideration.
