Fed. Circ. Cools Suit Over Tariffs For Men's Gloves

Law360, New York (February 8, 2010, 1:54 PM EST) -- A federal appeals court has upheld a ruling tossing Totes-Isotoner Corp.'s lawsuit against the United States alleging that higher customs duties for men's gloves are discriminatory.

In a decision issued Friday the U.S. Court of Appeals for the Federal Circuit agreed with a U.S. Court of International Trade ruling, finding that Totes, a marketer of gloves, raincoats, umbrellas and other inclement weather products, had not sufficiently claimed that the classifications on which the duties are based harmed a specific gender group.
