Insurers Can't Dodge Cancer Patient Payout: 4th Circ.

Law360, New York (February 9, 2010, 2:30 PM EST) -- Rejecting Kenneth W. Starr's argument that a new state law should trump a federal court's previous decision against his clients, a court of appeals has affirmed that two insurers owe holders of cancer policies for the entire sum doctors charge patients.

The U.S. Court of Appeals for the Fourth Circuit affirmed on Monday a federal judge's decision not to apply the new South Carolina law to favor Dixie National Life Insurance Co. and National Foundation Life Insurance Co.
