Judge Invalidates Wellman Patents In PET Resin Spat

Law360, New York (February 10, 2010, 6:01 PM EST) -- A federal judge has invalidated two polyethylene terephthalate resin patents that Wellman Inc. tried to assert against rival beverage packaging resin manufacturer Eastman Chemical Co.

In granting Eastman’s motion for summary judgment, Judge Sue L. Robinson of the U.S. District Court for the District of Delaware found that the patents were invalid for failing to set forth the best mode and for indefiniteness.
