10th Circ. Grounds Plane De-Icing Suit

Law360, New York (February 11, 2010, 4:53 PM EST) -- The U.S. Court of Appeals for the Tenth Circuit has affirmed the dismissal of a suit brought by current and former airline employees claiming full plane de-icing at the city's airport is harmful to human health and to the environment.

In a unanimous decision on Monday, the Tenth Circuit effectively grounded the suit against the city-operated Denver International Airport, which claimed that aircraft de-icing fluid presents an imminent and substantial endangerment to health.
