High Court Ruling Could Spur Action On NLRB Vacancies

Law360, New York (March 18, 2010, 6:28 PM EDT) -- The political gridlock that has kept membership on the National Labor Relations Board to two people for more than two years could ease if the U.S. Supreme Court likes what it hears from petitioner New Process Steel LP in Tuesday's oral arguments over the validity of the bare-bones board.

The high court will weigh the company's claim that the five-member board has had no authority to decide unfair labor practice and union representation disputes since membership dropped to two people on Dec. 31, 2007.
