Esso CERCLA Counterclaim Tossed In Oil Leak Suit

Law360, New York (February 23, 2010, 3:39 PM EST) -- A federal judge has dismissed one of Esso Standard Oil Co.'s environmental counterclaims in a Puerto Rican property owners' suit over oil leaks that caused damage and contamination to the land and water at one of company's service stations.

Judge Jose Antonio Fuste of the U.S. District Court for the District of Puerto Rico on Monday dismissed Esso's counterclaim seeking to hold Jorge Francisco-Sanchez liable under the Comprehensive Environmental Response, Compensation and Liability Act for response costs at the Dolores Service Station.
