Blue Cross Wins Deductible Class Action In 11th Circ.

Law360, New York (February 26, 2010, 1:57 PM EST) -- A federal appeals court has affirmed a lower court's decision to toss a putative class action that alleged Blue Cross and Blue Shield of Alabama Inc. improperly charged deductibles to the participants of a group health insurance plan.

The U.S. Court of Appeals for the Eleventh Circuit affirmed Thursday the decision of the U.S. District Court for the Middle District of Alabama to throw out the lawsuit that Robert Heffner, a former executive at an insurance company, first filed against Blue Cross in 2000.
