Micron Loses Bid To Nix Claims In Drug Contract Spat

Law360, New York (February 26, 2010, 4:03 PM EST) -- A federal judge has shot down Micron Technologies Inc.'s bid to toss half the claims in Armstrong Pharmaceuticals Inc.’s breach of contract suit accusing Micron of failing to properly micronize two batches of albuterol for use in Armstrong's inhalers.

Judge Rya W. Zobel of the U.S. District Court for the District of Massachusetts on Thursday rejected Micron's Sept. 14 request to cut Armstrong's allegations of deceit, unjust enrichment and state trade practice violations from the suit, which also alleges breach of contract, negligent misrepresentation and breach...
