Bayer Sued Over Fly Ash Removal Contract Settlement

Law360, New York (February 26, 2010, 3:49 PM EST) -- A lawsuit accusing Bayer CropScience LP of shirking its obligations under a settlement based on a predecessor's default on a contract for fly ash removal at two West Virginia sites has been removed to a federal court.

On Thursday Bayer removed to the U.S. District Court for the Southern District of West Virginia the suit filed by Hatfield Enterprises Inc. over the company's alleged failure to pay fees for fly ash removal in its capacity as a successor to Union Carbide Corp.
