DC Circ. Won't Look At NM Oil Competition Claims

Law360, New York (March 1, 2010, 4:38 PM EST) -- A federal appeals court has declined to take up an attempt by an oil company and the Navajo Nation to have a regulator investigate alleged anti-competitive conduct by Western Refining Pipeline Co. in the oil industry in New Mexico.

A three-judge panel in the U.S. Court of Appeals for the District of Columbia Circuit on Friday ruled that the Federal Energy Regulatory Commission's decision not to take up such an investigation is not reviewable by a court, citing the Interstate Commerce Act.
