EPA Ducks Liability In Farm Sludge Whistleblower Suit

Law360, New York (March 1, 2010, 2:30 PM EST) -- A federal appeals court has ruled that the U.S. Environmental Protection Agency bears no liability in a whistleblower case brought by a microbial ecologist whose warnings about the health effects of treated sewage applied to farm land came under attack by an EPA scientist.

Wednesday's ruling, in the U.S. Court of Appeals for the Eleventh Circuit, upheld the U.S. Department of Labor's Administrative Review Board's decision against Dr. David Lewis, whose complaint had claimed an EPA official's attacks on his work meant the agency bore liability....
