Stryker Loses Bid To Toss Pain Pump Liability Suit

Law360, New York (March 2, 2010, 1:48 PM EST) -- A federal judge has refused to dismiss a lawsuit against Stryker Corp. and McKinley Medical LLC that alleges a pain pump made by the two companies did not include warnings it could lead to cartilage injury.

Judge Patricia Fawsett of the U.S. District Court for the Middle District of Florida rejected the companies' arguments on Friday, saying the lawsuit filed by Ashley L. Jozwiak, who suffered serious cartilage injury to her shoulder after a pain pump was installed, met federal pleading standards.
