Sterling Misfires In Bid To Trim EEOC Sex Bias Suit

Law360, New York (March 2, 2010, 12:21 PM EST) -- Sterling Jewelers Inc. can't appeal an order that thwarted its attempt to kill part of a U.S. Equal Employment Opportunity Commission suit accusing it of sex bias, a federal judge has ruled, reasoning that an appeal wouldn't "control" the litigation.

Judge Richard Arcara of the U.S. District Court for the Western District of New York on Friday denied Sterling's motion for certification of an interlocutory appeal of an order in favor of the EEOC.
