1st Circ. Clears Up Arbitration Stay Procedure

Law360, New York (March 2, 2010, 4:38 PM EST) -- Tackling the issue for the first time, the U.S. Court of Appeals for the First Circuit has found that magistrate judges' decisions on motions to stay pending arbitration do not require a fresh look by a district judge.

On Monday a three-judge panel that included retired U.S. Supreme Court Justice David Souter issued the standard as a matter of first impression while examining a 2003 business agreement between Powershare Inc. and Syntel Inc. that had gone south.
