9th Circ. Stands By Nixing Of $32M BPA, Alcoa Contract

Law360, New York (March 2, 2010, 7:34 PM EST) -- The U.S. Court of Appeals for the Ninth Circuit has shut the door on hopes that it would reconsider its decision to invalidate a $32 million payment from Bonneville Power Administration to Alcoa Inc., which the BPA said would help keep a troubled aluminum smelter open.

The Ninth Circuit on Tuesday issued an amended opinion that buttresses its August justifications for overturning the deal, which would have had the government-run BPA pay Alcoa $32 million so that it could buy power from BPA's competitors.
