Fed. Circ. Sides With Atty In IP Legal Malpractice Suit

Law360, New York (March 3, 2010, 1:21 PM EST) -- A federal appeals court has approved the dismissal of a legal malpractice suit against a Brouse McDowell LPA attorney whom a social networking Web site inventor implicated for her failure to secure U.S. and international patents.

In an opinion published Tuesday, a three-judge panel of the U.S. Court of Appeals for the Federal Circuit affirmed a district court ruling that found solo inventor Heather A. Davis had failed to meet a legal standard requiring her to prove that her social networking software was patentable.
