Utilities' Pay Records Are Proprietary Info: Fla. Court

Law360, New York (March 3, 2010, 4:55 PM EST) -- A Florida appeals court on Wednesday reversed a state agency's order denying a request by Florida Power & Light Co. and Progress Energy Florida Inc. to treat employee compensation records as proprietary business information and exempt from public disclosure during hearings on rate increases.

A three-judge panel of Florida's First District Court of Appeal ruled Wednesday that the Florida Public Service Commission improperly denied the utilities' confidentiality motions by employing an overly narrow reading of the relevant state law.
