Exxon Solely Liable For Gas Station Cleanup: 9th Circ.

Law360, New York (March 5, 2010, 1:37 PM EST) -- A federal appeals court has upheld a lower court's ruling that a gas station purchase contract between Exxon Mobil Corp. and New West Petroleum Inc. does not require New West to clean up certain methyl tertiary butyl ether contamination at the site.

The U.S. Court of Appeals for the Ninth Circuit issued the three-paragraph ruling Thursday. Both parties had asserted various claims against one another, but the district court held that neither could make any recovery.
