Ford Correctly Classified Ex-Visteon Workers: 6th Circ.

Law360, New York (March 11, 2010, 3:06 PM EST) -- A federal appeals court has ruled that Ford Motor Co. did not misclassify longtime workers or deny them proper retirement benefits when it regained direct control over much of bankrupt auto parts maker Visteon Corp.

A three-judge panel of the U.S. Court of Appeals for the Sixth Circuit ruled Wednesday that Ford had correctly classified the workers at two Michigan plants as “rehired” rather than “reinstated” based on a 1991 company directive.
