Insurer Ruled Not Liable For Ky. Coal Dust Pollution

Law360, New York (March 15, 2010, 1:18 PM EDT) -- Wausau Underwriters Insurance Co. does not need to reimburse a Kentucky coal plant operator for alleged damage caused by coal dust pollution to nearby residences, a federal judge has ruled.

Judge Karen Caldwell of the U.S. District Court for the Eastern District of Kentucky agreed with Wausau on Thursday that four insurance policies issued to Grizzly Processing LLC explicitly excluded coverage for certain pollution, including coal dust.
