NY Attorney Ad Rules Unconstitutional: 2nd Circ.

Law360, New York (March 15, 2010, 6:43 PM EDT) -- New York state rules barring certain attention-getting tactics in attorney advertising are unconstitutional, a federal appeals court has ruled, largely backing a lower court's decision nixing many of the restrictions.

In ruling issued Friday the U.S. Court of Appeals for the Second Circuit said content-based restrictions on attorney advertising imposed by 2007 rules adopted by New York Supreme Court's Appellate Division violate the First Amendment, agreeing for the most part with a New York law firm and public interest organization Public Citizen, which had challenged the...
