Tomkins Escapes Liability In Tenn. TCE Pollution Suit

Law360, New York (March 17, 2010, 4:16 PM EDT) -- A federal judge has dismissed Tomkins PLC, a global engineering and manufacturing group based in London, from three lawsuits that alleged the company is liable for polluting Tennessee groundwater with trichloroethylene.

Judge William Haynes Jr. of the U.S. District Court for the Middle District of Tennessee ruled Monday that the court lacked jurisdiction over Tomkins, a foreign company, because the corporation did not exert enough control over the subsidiary that was accused of causing the pollution.
