Appeals Court Vacates Ventana Ruling

Law360 (January 1, 2007, 12:00 AM EST) -- The U.S. Court of Appeals for the Federal Circuit decided on Friday that a BioGenex Laboratories Inc. product might infringe on a patent held by Ventana Medical Systems Inc., vacating a district court decision.

The appellate court’s decision said the lower court “erred in its claim construction” and remanded the case back the District Court for the District of Arizona for further proceedings.
