SEC Atty Seeks To Avoid Deposition In Fraud Suit

Law360, New York (March 18, 2010, 4:19 PM EDT) -- The U.S. Securities and Exchange Commission is seeking to block the deposition of one of its attorneys in the agency's securities fraud case against former Aerokinetic Energy Corp. general counsel Daniel W. Nodurft.

Nodurft has asked the attorney to produce documents at deposition in a deliberate attempt to obtain material protected by attorney-client privilege, the work product doctrine and the deliberative process privilege, the SEC said in an emergency motion for protective order filed Wednesday in the U.S. District Court for the Middle District of Florida....
