Ford Loses Appeal Bid In $2.6M Harbor Tax Suit

Law360, New York (March 22, 2010, 3:16 PM EDT) -- Ford Motor Co. has lost a bid to file an interlocutory appeal in its challenge over $2.6 million in harbor maintenance taxes — deemed unconstitutional by the U.S. Supreme Court — that the U.S. government has refused to pay back.

Judge Leo M. Gordon of the U.S. Court of International Trade ruled Friday that Ford's proposed appeal, which concerns the use of certain U.S. Customs and Border Protection documents as evidence, would delay, rather than advance, the litigation.
