Mining Cos. Appeal Invalidation Of Army Corps Permit

Law360, New York (March 24, 2010, 2:42 PM EDT) -- Loadout LLC and Coal River Mining LLC have asked a federal appellate court to review a lower court ruling that deemed the U.S. Army Corps of Engineers' permit for two West Virginia mines invalid because a public comment period requirement had been largely ignored.

The mining companies, intervenor-defendants in the suit between several environmental coalitions and the Army Corps, also requested a stay from the earlier order pending the U.S. Court of Appeals for the Fourth Circuit's decision, according to motions lodged Tuesday in the U.S....
