ADT Loses Bid To Toss Retaliation Suit

Law360, New York (March 26, 2010, 3:51 PM EDT) -- A judge has refused to dismiss a retaliation suit brought by two former employees of ADT Security Services Inc. who were fired after filing a wage-and-hour complaint with the state of Maryland.

Judge Deborah K. Chasanow of the U.S. District Court for the District of Maryland said in an opinion Wednesday that the case brought by Sharon Randolph and Tami Thompson should go forward, rejecting ADT’s argument that the plaintiffs needed an actionable wage-and-hour claim under the Fair Labor Standards Act to file a retaliation claim...
