Ariz. City Police Lose Don, Doff Appeal

Law360, New York (March 26, 2010, 4:07 PM EDT) -- A federal appeals court has upheld summary judgment against police officers who filed a putative class action against the city of Mesa, Ariz., claiming they were entitled under the Fair Labor Standards Act to pay for time they spent donning and doffing uniforms and gear.

The U.S. Court of Appeals for the Ninth Circuit on Thursday affirmed the judgment, noting officers had the option of donning and doffing their uniforms and gear at home, so those activities were not compensable pursuant to the FLSA.
