Arch Coal Mountaintop Mine An Enviro Threat: EPA

Law360, New York (March 26, 2010, 6:47 PM EDT) -- In an unprecedented move, the U.S. Environmental Protection Agency said Friday it could veto a Clean Water Act permit issued to an Arch Coal Inc. unit allowing for mountaintop removal at a coal mine in West Virginia.

The agency proposed modifying or outright withdrawing the Section 404(c) permit issued to Mingo Logan Coal Co. at its Spruce No. 1 surface mine in Logan County, W.Va., in order to prevent what the EPA described as irreversible environmental damage.
