Coleman Not Liable For Heater Deaths: 9th Circ.

Law360, New York (March 29, 2010, 6:49 PM EDT) -- The U.S. Court of Appeals for the Ninth Circuit has affirmed a jury's finding that Coleman Co. Inc. was not liable for the carbon monoxide deaths of two men who used a Coleman heater inside their camper.

The appeals court ruled 2-1 on Friday that the U.S. District Court for the Western District of Washington did not err by failing to instruct the jury that Coleman had a post-sale duty to warn about the carbon monoxide risk of operating heaters in enclosed areas.
